Saturday April 30th, 2011 - The court hearing for the case against the two prominent student activists Bahareh Hedayat and Majid Tavakoli for publishing a letter on the occasion of Students' Day, took place at the 28th Branch of the Islamic Revolutionary Court today Saturday April 30th, 2011, in the presence of their lawyers.
According to Daneshjoo News, following the increase in pressure on incarcerated students to deny the statements published on their behalf, Majid Tavakoli, Bahareh Hedayat and their respective lawyers were once again summoned to the 28th Branch of the Islamic Revolutionary Court this morning presided over by Judge Moghiseh.
Judge Moghiseh, renowned for his cooperation with security forces and his non compliance with judicial independence, had verbally attacked the students on previous occasions and a prior trial, demanding that they deny the statements published on their behalf by various media outlets and to file a complaint against the website and others responsible for publishing the alleged statements. Moghiseh had announced that if they complied with the demands by the security forces, all charges against these students would be dropped and their case would be closed in court. Given Hedayat and Tavakoli refusal to comply with the demands of the security forces, they were once again tried in court today on charges of "propaganda against the regime", and "conspiring to act against the national security of the country".
According to Daneshjoo News, the increase in pressure on incarcerated students to deny any statements published on their behalf and declare their antipathy against the Green movement and the protests in the recent years, comes at a time when all visitation and telephone contacts have also been periodically banned. Despite pressures such as student activists being forced to participate in show trials and their families summoned for interrogations, and demands such as families providing written statements guaranteeing that they will not engage in interviews with media outlets, the students have to date rejected the illegal demands made by the judiciary.
Bahareh Hedayat, Majid Tavakoli and Mahdiyeh Golroo were previously summoned to the 28th Branch of the Islamic Revolutionary Court on February 1st last year without the presence of their lawyers. At the time, the students had rejected the demands by Judge Moghiseh and announced that they will only defend themselves at a trial where their lawyers are also present. The three student activists had also strongly protested the court proceedings and remarks by Judge Moghiseh. Following the complaints, Judge Moghiseh had insulted Majid Tavakoli and expelled him from court.
Prior to the incomplete trial for the two incarcerated students, Bahareh Hedayat and Majid Tavakoli were interrogated on December 27th, 2010 at the 4th Interrogation Branch of the Court in Evin prison. During the interrogations the students had been asked to condemn the leaders of the Green movement and the sites that had published statements on their behalf in order for the charges against them to be dropped. It goes without saying that Hedayat and Tavakoli rejected any such demands.
Bahareh Hedayat member of the Central Council of the Office for Promoting Unity and the public relations officer of this student union was arrested on December 31st, 2009 and sentenced to 9 1/2 years prison by the 28th branch of the Islamic Revolutionary Court presided over by Judge Moghiseh.
Majid Tavakoli a former member of the Islamic Association of Amir Kabir University was sentenced to 8 years behind bars and sent to exile at Rajai Shahr prison.
The rulings against Hedayat and Tavakoli are the heaviest sentences rendered by the Islamic Revolutionary Court against student activists to date.

دادگاه بهاره هدایت و مجید توکلی با حضور وکلای مدافع برگزار شد

دادگاه بهاره هدایت و مجید توکلی دو فعال سرشناس دانشجویی به علت انتشار نامه به مناسبت روز دانشجو، امروز شنبه ۱۰ اردیبهشت ماه در شعبه ۲۸ دادگاه انقلاب برگزار شد.
به گزارش دانشجو نیوز، در پی افزایش فشارها بر دانشجویان زندانی برای تکذیب نوشته ها و بیانیه های منتشر شده از سوی ایشان، صبح امروز مجید توکلی و بهاره هدایت با حضور وکلای مدافع شان باردیگر به شعبه ۲۸ دادگاه انقلاب اسلامی به ریاست قاضی مقیسه فراخوانده شدند.
قاضی مقیسه که به همکاری با نیروهای امنیتی و عدم رعایت استقلال قضائی شهرت دارد، پیش از این و در دادگاه های قبلی با حمله به دانشجویان از آنان خواسته بود که با تکذیب بیانیه های منتشر شده و نوشته هایی که به بیرون از زندان درج شده است، از سایت ها و عاملان انتشار این مطالب نیز اعلام شکایت کنند. وی اعلام کرده بود که در صورت پذیرش خواست مسئولان امنیتی تمامی اتهامات جاری این دانشجویان پایان یافته و پرونده در همین جلسه دادگاه مختومه خواهد شد. اما با عدم پذیرش خواست مسولین امنیتی بار دیگر این دانشجویان زندانی با اتهامات "تبلیغ علیه نظام "و "تبانی جهت اقدام علیه امنیت ملی" در دادگاه امروز محاکمه شدند.
به گزارش دانشجو نیوز، افزایش فشار بر دانشجویان زندانی برای تکذیب اظهارات و بیانیه های خود و اعلام انزجار از جنبش سبز و اعتراضات سالهای اخیر، در حالی افزایش می یابد که قطع تمامی ملاقات ها و تلفن های ایشان در بازه های زمانی مختلف در کنار برگزاری دادگاه های فرمایشی، احضار و بازجویی از خانواده های ایشان و اخذ تعهد از خانواده های زندانیان سیاسی مبنی بر عدم مصاحبه با رسانه ها، تا کنون با مقاومت دانشجویان و رد درخواست های غیرقانونی بی اثر مانده است.
بهاره هدایت، مجید توکلی و مهدیه گلرو پیش از این نیز در تاریخ ۱۲ بهمن ماه سال گذشته بدون حضور وکلای مدافع شان به شعبه ۲۸ دادگاه انقلاب فراخوانده شده بودند که در آن جلسه دادگاه، دانشجویان بار دیگر ضمن رد خواسته قاضی مقیسه اعلام کردند که در دادگاهی که تنها با حضور وکیل برگزار شود از اتهامات خود دفاع خواهند کرد. این ٣ فعال دانشجویی همچنین به روند برگزاری آن دادگاه و اظهارات قاضی مقیسه به شدت اعتراض کردند. در پی این اعتراض ها، قاضی مقیسه با کار بردن الفاظی توهین آمیز مجید توکلی را از دادگاه اخراج کرد.
قبل از دادگاه نیمه تمام این دانشجویان در بهمن ماه، بهاره هدایت و مجید توکلی در ۶ دی ماه در شعبه ٤ بازپرسی دادسرای اوین مورد بازجویی قرار گرفته بودند. در این دادگاه ها از این دانشجویان خواسته شده بود تا با موضع گیری علیه رهبران جنبش سبز و سایت های منتشر کننده نوشته های دانشجویان، از خود رفع اتهام نمایند که این موضوع با واکنش شدید آنها روبه رو شده بود.
بهاره هدایت عضو شورای مرکزی دفتر تحکیم وحدت از تاریخ ۱۰ دی ماه ۱۳۸۸ بازداشت و توسط شعبه ۲۸ دادگاه انقلاب به ریاست قاضی مقیسه به حکم سنگین ۹ سال و نیم زندان محکوم شده است.
مجید توکلی عضو سابق انجمن اسلامی دانشگاه امیرکبیر نیز به ۸ سال زندان و تبعید به زندان رجایی شهر کرج محکوم شده است. این احکام از جمله سنگین‌تر احکام حبس صادر شده برای فعالین دانشجویی است
