December 24th, 2010 - Habiballah Latifi is scheduled to be executed on Sunday December 26th, 2010. His lawyer, Saleh Neekbakht was only informed of this fact on Thursday December 23rd. In an interview with Kurdish Perspective, Habiballah's family confirm the news of his scheduled execution and respond to a number of questions.
We first asked Habib's sister, who is under extreme psychological distress to provide us with details on the events of the recent days and how she received the news of her brothers potential execution. To which she responded:
Mr. Saleh, my brother's lawyer contacted us yesterday. He was very distressed. He informed us that Habib is to be executed at 6:30am on December 26th, 2010. He had apparently received the news by fax. Even Mr. Neekbakht was at a loss for words when hearing the news, as his case file had been moving in a positive direction. The truth is, all of us were taken aback and shocked by this news.
Latifi's sister was so distressed that she was unable to continue with the interview. As a result we continued the interview with his niece. Earlier Mr. Neekbakht had indicated that Latifi's case had been referred to the Amnesty Commission in Tehran for review and that a sentence would not be rendered until further clarification and review by the commission.
Did the Judiciary officials respond to your request for Amnesty?
Unfortunately the Judiciary officials never forwarded the case to the Amnesty Commission. The statements by the Judge responsible for the case and the sentence rendered were completely contradictory.
What does his lawyer intend to do in order to prevent the sentence from being executed? In addition to taking legal action, have you approached the members of the parliament regarding this matter?
Mr. Neekbakht is coming to Sanandaj tomorrow in order to further discuss the matter with Hassan Babai the Judge responsible for this case. Mr. Neekbakht has stated that he will request yet another hearing. We have no hope in the Kurdish representatives in the parliament and as such we have not approached them. Their is no history of them ever helping anyone under these circumstances.
When was your last visit with Habib? Does he still suffer from a stomach infection?
We were allowed to see him for 15 minutes from behind a cabin on Tuesday. Habib was not aware of the news at the time. Unfortunately as a result of the lack of medical attention in prison, Habib's gum disease has now progress to his stomach. He continues to suffer from this condition.
What is your message to the people of Kurdistan and Iran?
As a representative of Habib's family I request that all citizens, particularly human rights activists and human rights organizations do everything in their power to overturn this sentence. We must defend every activist that has fought for human dignity. Remaining silent is NOT an option. Defending Habib and others sentenced to death, is defending humanity.
خانواده حبیب الله لطیفی: سکوت جایز نیست

قرار است حبیب الله لطیفی، روز یک شنبه اعدام شود. خبری که روز پنج شنبه اول دیماه به صالح نیکبخت، وکیل این زندانی کرد ابلاغ شد.
خانواده حبیب الله لطیفی در مصاحبه با کردیش پرسپکتیو، ضمن تائید این خبر به چند سئوال دیگر نیز پاسخ دادەاند:
ابتدا از خواهر حبیب در باره چگونگی دریافت این خبر و اطلاعات دیگری که احیانا در این باره دارند پرسیدم.
وی که در شرایط نامناسب روحی به سر می برد پاسخ داد:
روز گذشته آقای صالح نیکبخت با ما تماس گرفت و در حالیکه به شدت متاثر بود به ما گفت که قرار است حبیب ساعت 6:30 دقیقه صبح روز یک شنبه، یعنی دو روز دیگر اعدام شود. گویا این خبر از طریق فاکس به ایشان ابلاغ شده بود.
این موضوع حتی برای آقای نیکبخت نیز غیر قابل باور بود، چرا که ظاهرا پرونده روند مثبتی را طی می نمود و هیچ یک از ما اننتظار شنیدن چنین خبری را نداشتیم.
به دلیل شدت نگرانی خواهر حبیب الله لطیفی، وی قادر به ادامه انجام مصاحبه نبود و به همین خاطر دیگر پرسش ها را با خواهرزادەی این فعال کرد مطرح نمودیم.
پیش تر آقای نیکبخت این موضوح را مطرح نموده بود که پرونده جهت رسیدگی در کمیسیون عفو به تهران ارسال شده و تا پیش از روشن شدن این درخواست، حکم اجرا نخواهد شد .
آیا مقامات قضایی به این تقاضا پاسخ داده بودند؟
متاسفانه باید بگویم که این مقامات، پرونده را اصلا به کمیسیون عفو ارسال ننموده بودند، تا در آنجا مورد رسیدگی قرار گیرد.
اظهارات قاضی پرونده و دایرەی اجرای احکام در این باره کاملا متناقض بود.
چه اقداماتی قرار است از سوی وکیل پرونده جهت جلوگیری از اجرای این حکم صورت بپذیرد؟
آیا غیر از وکیل، موضوع را از طریق نمایندگان مجلس پیگیری نمودەاید؟
قرار است فردا آقای نیکبخت به سنندج بیایند و در این باره با قاضی پرونده، آقای حسن بابایی صحبت کنند. ایشان اظهار داشتەاند که مجددا درخواست اعاده دادرسی را مطرح خواهند نمود.
به نمایندگان کرد در مجلس شورای اسلامی هیچ امیدی نداریم که بخواهیم از طریق آنان موضوع را پیگیری نمائیم. چرا که چنین سابقەای در کارنامه آنان وجود ندارد.
آخرین ملاقات شما با حبیب کی بود؟ آیا وی همچنان از بیماری عفونت معده رنج می برد؟
روز سه شنبه توانستیم به مدت 15 دقیقه با او ملاقات کابینی داشته باشیم. حبیب از موضوع خبر نداشت.
متاسفانه عدم مداوای عفونت دندانهای حبیب که در زندان به آن مبتلا شد، عفونت شدید در ناحیه معدەی را به دنبال داشته است.
بیماری که همچنان حبیب را آزار می دهد.
پیام شما در این شرایط، برای مردم کردستان و ایران چیست؟
من به عنوان نماینده خانواده حبیب از تمام مردم خصوصا فعالان حقوق بشر و سازمانهای مرتبط می خواهم که از هیچ تلاشی برای متوقف نمودن اجرای این حکم دریغ نکنند.
سکوت در قبال وضعیت تمام فعالانی که به خاطر دفاع از کرامت انسانها به اعدام محکوم شدەاند جایز نیست.
دفاع آنها از حبیب و دیگر محکومان به اعدام دفاع از انسانیت است
