BREAKING NEWS - Blogger Hossein Ronaghi-Maleki on Hunger Strike

Thursday, October 7th, 2010 - Hossein Ronaghi-Maleki, blogger and human rights activist sentenced to 15 years prison, has started a hunger strike.  Ronaghi-Maleki, aka, Babak Khoramdin, began his hunger strike a few days ago in protest to his unjust sentence and the manner in which his case file was handled by the judiciary.  Zelikha Mousavi, Hossein Ronaghi-Maleki's mother made the following statement to RAHANA: "Hossein Ronaghi-Maleki began a hunger strike a few days ago, demanding to meet with Tehran's prosecutor."

Mrs. Mousavi added: "We hadn't spoken to Hossein in the past two days, however someone informed us of his hunger strike yesterday. Hossein confirmed that he is on hunger strike, in a phone conversation we had with him today."

Hossein Ronaghi-Maleki was sentenced to 15 years prison on October 3rd, 2010 by branch 26 of the Revolutionary Court.  This sentenced was announced to him by Mr. Sattari, the court clerk in charge of branch 26.  Ronaghi-Maleki was not even allowed to read the verdict and he was threatened, beaten and forced to sign the court document containing his sentence.

Ronaghi-Maleki was arrested on December 13th, 2009 at his father's house in the city of Malekan in Tabriz.  He was transferred to ward 2A at Evin prison under the supervision of the IRGC.  Ronaghi-Maleki was put under extreme pressure during the past 10 months with the goal to obtain a false confession and television interview.

According to Rongahi-Maleki's family, the judicial authorities stated that he was first sentenced to death, but his sentenced was later reduced to a 15 year prison term. The judicial authorities informed the family that had Ronaghi-Maleki cooperated he would have received a lesser sentence.

It is worth mentioning that Ronaghi-Maleki's family and lawyer have yet to be officially informed of his 15 year prison sentenced.

حسین رونقی ملکی وبلاگ‌نویس و فعال حقوق بشر که در دادگاه بدوی به ۱۵ سال زندان محکوم شده دست به اعتصاب غذا زده است.
حسین رونقی ملکی معروف به بابک خرمدین طی روزهای گذشته در اعتراض به حکم صادر و نحوه برخورد مقامان قضایی دست به اعتصاب غذا زده است. زلیخا موسوی، مادر حسین رونقی با اعلام این به رهانا گفت: «حسین رونقی در روزهای گذشته دست به اعتصاب غذا زده و خواسته‌اش را دیدار با دادستان تهران اعلام کرده است.»

خانم موسوی به رهانا گفت: «طی دو روز گذشته حسین با ما تماس نگرفت، شخصی خبر اعتصاب غذای حسین را دیروز به ما داد و امروز خود حسین در تماس تلفنی به ما گفت که در اعتصاب غذا به سر می‌برد.

حسین رونقی ملکی در تاریخ ۱۱ مهر ماه حکم ۱۵ سال زندان خود را در دادگاه انقلاب و از طرف شعبه ۲۶ دادگاه انقلاب دریافت کرد. این حکم توسط ستاری، سردفتر شعبه ۲۶ دادگاه انقلاب به این وبلاگ‌نویس ابلاغ شد. به رونقی اجازه رویت و خواندن حکم را نداده و او را با ضرب و شتم و تهدید وادار به امضای حکم ابلاغ شده کرده بودند.

لازم به یادآوری است که حسین رونقی ملکی از تاریخ ۲۲ آذر ماه گذشته در منزل پدریش در شهر ملکان تبریز بازداشت و به سلول‌های انفرادی بند ۲ الف زندان اوین که زیر نظر سپاه پاسداران است منتقل شد. رونقی در طول ۱۰ ماه گذشته به شدت برای اخذ اعتراف و مصاحبه تلویزیونی تحت فشار بوده است.

به گفته‌ی خانواده‌ی رونقی مسئولین قضایی عنوان کرده‌اند که حکم وی اعدام بوده است، اما به وی تخفیف داده‌اند. همچنین آن‌‌ها اعلام کرده‌اند که در صورتی که وی همکاری می‌کرد، حکم سبک‌تری به او می‌داده‌اند.

لازم به ذکر است حکم ۱۵ سال زندان این وبلاگ‌نویس هنوز به وکیل وی آقای دادخواه اعلام نشده است و این حکم در دادگاه بدوی صادر شده است.

BREAKING NEWS- Nasrine Sotoudeh Imprisoned Human Rights Lawyer on Hunger Strike Since September 25th, 2010

Wednesday October 6th, 2010 - Summary: In a short telephone conversation from prison with her husband, Nasrine Sotoudeh, human rights lawyer informed him that she has been on a hunger strike since September 25th, 2010.  According to reports from Jaras, Reza Khandan, Sotoudeh's husband stated that after this short telephone conversation all telephone contact with this well known lawyer was cut off.

Soutoudeh, international human rights lawyer and mother of two young children was arrested on September 4th, 2010. Her last telephone conversation with her family took place on September 18th when she informed them that she planned to go on a hunger strike if her rights would continue to be ignored as an imprisoned citizen.  It is this intent that led to extreme concern by her loved ones for her well being in recent days.  Today it was confirmed that she has been on a hunger strike for over 10 days. 

The International Committee for Human Rights in Italy, presented their first award in 2008 to Nasrin Soutoudeh. In recent years, Nasrin Sotoudeh, was legal council to a considerable number of political activists, journalists, civil activists and youth accused and incarcerated by the Islamic Repbulic of Iran.

چکیده : سرین ستوده حقوقدان پیگیر حقوق بشر، در تماس کوتاهی با همسر خود تصریح کرد که از سوم مهرماه در اعتصاب غذا بسر می‌برد. بر اساس گزارش رسیده به جرس، رضا خندان، همسر ستوده تاکید می‌کند که پس از این تماس کوتاه، ارتباط تلفنی این وکیل برجسته قطع شده است.

نسرین ستوده حقوقدان پیگیر حقوق بشر، در تماس کوتاهی با همسر خود تصریح کرد که از سوم مهرماه در اعتصاب غذا بسر می‌برد. بر اساس گزارش رسیده به جرس، رضا خندان، همسر ستوده تاکید می‌کند که پس از این تماس کوتاه، ارتباط تلفنی این وکیل برجسته قطع شده است.
ستوده، کارشناس ارشد حقوق بین‌الملل و مادر دو کودک خردسال، ۱۳ شهریورماه گذشته بازداشت شد. آخرین تماس تلفنی وی ۲۷ شهریورماه بود. وی تاکید کرده بود که در صورت عدم رعایت حقوق شهروندی‌اش در زندان، اعتصاب غذا خواهد کرد. همین امر، به دل‌نگرانی‌ها در مورد وضع جسمی وی در روزهای اخیر دامن زد؛ تا آنکه امروز مشخص شد وی بیش از ۱۰ روز است که در اعتصاب غذا بسر می‌برد.

کمیته بین‌المللی حقوق بشر ایتالیا ، نخستین جایزه خود را در سال ۲۰۰۸ به نسرین ستوده اهدا کرد. نسرین ستوده، وکیل مدافع جمع قابل توجهی از فعالان سیاسی، روزنامه‌نگاران، کنشگران مدنی و نوجوانان متهم در سال‌های اخیر بوده است

Tuesday October 5th, 2010 - Hossein Ronaghi-Maleki was told that he has been sentenced to 15 years in jail. This announcement was made to him without the presence of his lawyers or the presiding judge Pir Abbasi, by Mr. Sattari, the court clerk in charge of the Revolutionary Court's Branch number 26, who forced Ronaghi-Maleki to sign and accept the rendered sentence.

Hossein Ronaghi-Maleki (a.k.a Babak Khorramdin) was arrested along with his brother Hassan Ronaghi-Maleki on the December 13th, 2009 in the city of Malekan near Tabriz and transferred to Evin prison.  According to RAHANA, during his 10 months in prison, Ronaghi- Maleki, a web blogger and human rights activist was exposed to both physical and psychological torture at Evin's ward 2A, with the hope to obtain a forced confession and television interview. 

As a result of Ronaghi-Maleki's refusal to confess to the crimes published in Keyhan newspaper this past March, interrogators and the judges in charge of his case file increased pressure on this web blogger keeping him in solitary confinement under the supervision of the IRGC forces. His brother Hassan Ronaghi-Maleki was released on 75,000 USD bail, after one month incarceration and enduring extreme torture.  During his time in jail he was repeatedly taken to interrogation rooms together with his brother. Hassan was repeatedly beaten and mistreated in order to force his brother Hossein into cooperation. 

The following is an account of the illegal and arbitrary actions of the judicial authorities in the Islamic Revolutionary Court with regards to Hossein Ronaghi-Maleki and his case file in the past month that culminated in a heavy 15 year prison sentence.  On October 2010, Hossein Ronaghi-Maleki was taken to Branch 26 of the Revolutionary Court and without the presence of his lawyers sentence to 15 years in prison.

On Monday Hossein Ronaghi-Maleki contacted his home and informed his family that he had been taken to court with out the presence of his lawyers or judge Pir Abbasi, the judge presiding over his case.  Hossein stated that Mr. Sattari, the court clerk was present and informed Hossein that he should have been sentenced to death and that indeed he had initially been given the death sentence, but the judiciary officials decided to change the verdict to a prison sentence instead.  In his telephone conversation with his family Ronaghi-Maleki added: "Mr. Sattari, did not allow for my lawyer to be present and said that I need to dismiss my lawyer if I don't want to be punished even further. After rendering the sentence, he beat me, pressured me and forced me to sign the court document. He didn't even allow me to read the sentence and forced me to sign it without reading out the verdict to me. Things are so bad nowadays that the court clerk has the power to act independently. It is truly regretful."  Ronaghi- Maleki's sentence was handed down without presenting any evidence of the supposed crimes he was accused of. It looks as though mere accusations and false information presented by the IRGC were sufficient to sentence this innocent web blogger. Moreover, Mr. Sattari the court clerk incharge of branch 26 of the Revolutionary Court stated: "Since Hossein Ronaghi-Maleki has not accepted the charges he has been accused of and has refused to give an interview and confess to his crimes, we decided to give him an even harsher sentence.  Had he confessed to his crimes, his sentence would have been reduced." Sattari had previously told Ronaghi-Maleki's mother that "Hossein should have been executed but we gave him a break!"

After spending 10 months in solitary confinement and enduring extensive pressure and torture by prison guards, Hossein Ronaghi-Maleki was initially taken to branch 26 of the Revolutionary Court on August 15th, presided by Judge Pir Abbasi.  On that day a 28,000 USD bail was set for his release. Though Ronaghi-Maleki's family provided the court with the bail amount and the bail was recorded by the court, Ronaghi-Maleki was nevertheless still not released from prison.  When his family approached branch 26 of the Revolutionary Court, they were informed by Mr. Sattari that the bail had been denied and that his prison sentence had been extended until September 18th, 2010.  When Hossein's family inquired as to the reason behind this decision, Mr. Sattari responded that the IRGC had sent them a letter requesting that bail be denied and that a prison sentence be reinstated instead.  Mr. Sattari had added that a report from the city of Malekan's Intelligence office had also been received, calling for the cancellation of Ronaghi-Maleki's bail and the reinstatement of the prison sentence. In addition, Sattari stated that the Malekan city council had also filed a report against Ronaghi-Maleki and his father and as such he would have to remain in custody. After bail was canceled and a prison sentence reinstated,  Hossein Ronaghi-Maleki was once again taken to Branch 26 of the Revolutionary Court on August 21st presided by Judge Pir Abbasi. His lawyer, Mr. Dadkhah was present on that day and presented an official complaint to the court about the illegal nature in which bail had been denied and a jail sentence reinstated.  Even though, his lawyer Mr. Dadkhah presented this legal complaint to branch 26, unfortunately on September 15th, it became evident that the written complaint filed by Ronaghi-Maleki and his lawyer had been removed from his case file. On this same date, Ronaghi-Maleki told Judge Pir Abbasi: "I endured extreme physical pain and torture at the hands of my interrogators. They pressured me and tortured me in order to force me to accept the false accusations."

Judge Pir Abbasi's response to Hossein Ronaghi-Maleki was as follows: "The interrogators did as they were told. We gave them the orders to torture you. You deserved it and we will continue to tell them to torture you." It was around the same time that Hossein's mother contacted Mr. Sattari the legal clerk at Branch 26 of the Revolutionary Court and complained about the torture both his son Hassan and Hossein had endured at the hands of the interrogators.  In response to her complaint, Mr. Sattari had said: "We can torture or kill anyone we want to and no one has the right to complain, or say anything to us!"

The individuals who have put extreme pressure on Hossein Ronaghi-Maleki and his family in the past 10 months, seeking to inflict an heavier sentence that 15 years prison for Ronaghi-Maleki are as follows: Judge Pir Abbasi, the judge presiding over branch 26 of the Revolutionary Court, Mr. Sattari, the court clerk and head of branch 26, his brother who was one of Hossein Ronaghi-Maleki's interrogators, a person by the name of "Eslami" in charge of the Revolutionary Court's archives, Parviz Sohrabi, Intelligence Officer, Parviz Alipour, commander of the Maragheh Information and resident of Malekan.  The unjust acts committed by these individuals include the arrest of Hassan Ronaghi-Maleki, Hossein's brother, who was beaten so severely that there were injuries to his neck and spine, threats to arrest his other family members including his father, demanding a multi million Touman bribe in order to release Ronaghi-Maleki, to name a few. It is also worth mentioning that the 15 year sentence handed down to Hossein Ronaghi-Maleki has not yet been officially communicated to his lawyers.

حکم ١۵ زندان حسین رونقی بدون حضور وکیل و قاضی پرونده و تنها توسط ستاری، سر دفتر شعبه ٢۶ دادگاه انقلاب به حسین رونقی اعلام شده و او را وادار به امضای حکم کرده‌اند

حسین رونقی ملکی (بابک خرمدین) در ٢٢ آذر ماه سال ١٣٨٨ در منزل پدریش در شهر ملکان در نزدیک تبریز به همراه برادرش حسن رونقی ملکی بازداشت و سریعا به زندان اوین تهران منتقل شد. به گزارش رهانا، سامانه خبری خانه حقوق بشر ایران، در طول ١٠ ماه بازداشت این وبلاگ‌نویس و فعال حقوق بشر وی مورد فشارهای روحی و جسمی شدید در بند ٢ الف زندان اوین برا اخذ اعتراف‌ و مصاحبه تلویزیونی قرار گرفت. به علت عدم اعتراف به اتهامات واهی که در اسفند ماه گذشته در روزنامه کیهان نیز منتشر شده بود، بازجویان و قضات پرونده بر این وبلاگ‌نویس جوان فشار بیش‌تری وارد آورده و او را تا کنون در سلول‌های انفرادی این بند از زندان اوین که زیر نظر اطلاعات سپاه پاسداران است، نگاه داشتند. حسین رونقی ملکی، برادر وی بعد از یک ماه بازداشت و تحمل شکنجه‌های شدید جسمی با قرار وثیقه ٨٠ میلیون تومانی از زندان آزاد شد. در طول مدت بازداشت وی را بارها در اتاق‌های بازجویی با برادر خود روبرو کرده و او را مورد ضرب و شتم قرار داده تا حسین رونقی را وادار به همکاری کنند. آن‌چه در زیر می‌آید گزارشی است از روند غیرقانونی و رفتارهای خودسرانه مسئولین در دستگاه قضایی و خاصه دادگاه انقلاب اسلامی در مورد حسین رونقی ملکی و پرونده وی در یک ماه اخیر که منجر به صدور حکم سنگین و دور از ذهن ١۵ سال زندان برای وی شده است. در تاریخ ١١ مهر ماه حسین رونقی به شعبه ٢۶ دادگاه انقلاب آورده شده و  در آن‌جا  بدون حضور وکلایش حکم صادر  شده مبنی بر ١۵ سال زندان  به وی اعلام شد.

روز دوشنبه حسین رونقی از زندان با خانه تماس گرفت و گفت که مرا به دادگاه بردند در حالی که  نه وکیلم حضور داشت و نه قاضی پرونده آقای پیر عباسی  و فقط منشی و سردفتر آقای ستاری در آن‌جا حضور داشتند. به من گفتند که حکم تو باید اعدام باشد و حکم اعدام به شما داده شده بود و ما آن را به  زندان تغییر دادیم. رونقی در این تماس تلفنی افزود که «آقای ستاری اجازه نداد وکیلم حضور پیدا کند و گفتند باید وکیل خود را عزل کنی وگرنه بد خواهی دید و بعد از نوشتن حکم صادره مرا با فشار و کتک  مجبور کرد تا حکم را امضا کنم. حتی اجازه خواندن حکم را نیز به من نداد  و  مجبور به امضای آن  بدون قرائت حکم کرد. در حال حاضر منشی در دادگاه چنان قدرتی پیدا کرده که  به طور مستقل عمل می‌کند و  یک باند قدرتمند ایجا کرده است، واقعا جای تاسف است .» حکم رونقی در حالی داده شد که حتی کوچک‌ترین  مدرکی برای  اتهامات وارده  ارائه نشده و فقط به اتهامات واهی و کذب اطلاعات سپاه بسنده شده است. همچنین ستاری رئیس دفتر شعبه ٢۶ دادگاه انقلاب گفته است که «چون حسین رونقی اتهامات را قبول نکرده و مصاحبه  و اعتراف را رد کرده است، ما هم حکمش را سنگین‌تر بریدیم و اگر به اتهامات  اعتراف می‌کرد تخفیف می‌دادیم.» وی پیش‌تر به مادر  این زندانی نیز گفته  بود که «حسین باید اعدام می‌شد ما تخفیف دادیم.»

حسین رونقی ملکی بعد از ١٠ ماه در انفرادی به سر بردن و تحمل فشار و شکنجه‌های متعدد در مورخه ٢۴ مرداد ماه به دادگاه برده شد و در شعبه ٢۶ دادگاه انقلاب به ریاست آقای پیر عباسی مورد محکامه قرار گرفت. در این روز قرار بازداشت حسین به قرار وثیقه ٣٠٠ میلیون تومانی تبدیل شد. خانواده ایشان وثیقه ٣٠٠ میلیون تومانی را تهیه کرده  که  توسط دادگاه  ضبط شد، ولی متاسفانه با تقدیم وثیقه ٣٠٠ میلیونی حسین رونقی آزاد نشد. هنگامی که خانواده حسین رونقی به شعبه ٢۶ دادگاه انقلاب مراجعه کردند از طرف آقای ستاری سر دفتر شعبه ٢۶ دادگاه انقلاب  به خانواده حسین رونقی اعلام شد که قرار وثیقه حسین رونقی به قرار بازداشت تبدیل شده و بازداشت حسین تا ۲۷ شهریور تمدید شده است. زمانی که خانواده حسین علت را جویا شدند، آقای ستاری گفته‌اند از طرف اطلاعات سپاه پاسداران نامه‌ای مبنی بر شکستن حکم قرار وثیقه حسین و تمدید قرار بازداشتش به دست ما رسیده است. همچنین  آقای ستاری اظهار کرده‌اند که گزارشی از طرف اطلاعات سپاه شهر ملکان ارسال شده و آن‌ها نیز خواستار لغو قرار وثیقه حسین رونقی شده‌اند و همچنین شهرداری شهرستان ملکان نیز علیه حسین و پدرش  گزارش داده‌اند و برای همین وی باید در بازداشت بماند. بعد از تبدیل قرار وثیقه به قرار بازداشت مجدد، حسین رونقی بار دیگر در مورخه ٣٠ مرداد ماه از زندان به شعبه ٢۶ دادگاه انقلاب به ریاست قاضی پیر عباسی  اعزام شد که در آن روز وکیل حسین رونقی  آقای دادخواه نیز در جلسه حاضر بودند و در همان روز حسین رونقی اعتراضی مبنی بر تبدیل غیر قانونی قرار وثیقه به قرار بازداشت تقدیم دادگاه کردند و وکیل ایشان آقای دادخواه نیز لایحه‌ای در اعتراض به آن شعبه تقدیم کردند ولی متاسفانه در تاریخ ١۵ شهریور معلوم شد که اعتراض حسین و لایحه وکیلش  از پرونده برداشته شده است. در همان تاریخ حسین رونقی به قاضی پیر عباسی گفته‌اند که «بازجویان مرا مورد شکنجه قرار دادند به طوری که به سختی صدمه دیدم. بازجویان می‌خواستند که من به زور اتهامات دروغین را بپذیرم و مرا تحت فشار وشکنجه مداوم قرار داده‌اند.»

پاسخ قاضی پیر عباسی به حسین رونقی این بوده که «بازجویان خوب کاری کرده‌اند و ما خودمان دستور دادیم شما را شکنجه کنند حق شما همین است و باز هم میگویم که شکنجه کنند.» در همان روز مادر وی نیز به ستاری سر دفتر شعبه ٢۶ دادگاه انقلاب مبنی بر شکنجه  پسرانش حسن و حسین رونقی  اعتراض کرده و از شکنجه آن‌ها توسط بازجوان شکایت کرده است. در جواب آقای ستاری گفته «ما هر کس را بخواهیم می‌توانیم شکنجه کنیم و بکشیم و کسی حق اعتراض ندارد و نمی‌تواند به ما چیزی بگوید.»

قاضی پیر عباسی  قاضی شعبه ٢۶ دادگاه انقلاب، ستاری سر دفتر شعبه ٢۶ دادگاه انقلاب اسلامی و برادر وی که یکی از بازجویان حسین رونقی بوده است؛ شخص به نام «اسلامی» که مسئول بایگانی دادگاه انقلاب است، پرویز سهرابی مأمور وزارت اطلاعات، پرویز علیپور فرمانده سپاه اطلاعات مراغه و ساکن شهر ملکان؛ سجاد لطفی  رئیس اطلاعات شهرستان ملکان؛ سیاوش جدی مامور اطلاعات شهرستان ملکان؛  کسانی هستند که در طی ١٠ ماه گذشته حسین رونقی و خانواده وی را به شدت تحت فشارهای گوناگون قرار داده و سعی بر آن دارند که حکمی سنگین‌تر از ١۵ سال زندان بر حسین رونقی تحمیل کننند. بازداشت حسن رونقی دیگر فرزند این خانواده و شکنجه‌های شدید وی تا حد آسیب زدن به مهره‌های گردن، تهدید به بازداشت اعضای خانواده و اقدام برای بازداشت پدر حسین رونقی ملکی، درخواست گرفتن رشوه چند میلیونی برای آزادی حسین رونقی و… از جمله اقداماتی است که توسط این افراد در طی ماه‌های گذشته بر حسین رونقی ملکی و خانواده‌اش وارد آمده و آنان را زیر فشارهای روحی قرار داده است. قابل ذکر است که حکم ۱۵ سال زندان حسین رونقی ملکی بدوی بوده و هنوز به وکلای وی نیز ابلاغ نشده است.

Zahra Rahnavard Strongly Condemns The Exile of Zia Nabavi & Other Prisoners

Tuesday October 4th, 2010 - Summary: Being exiled to a far away prison not only punishes the prisoners, but also punishes their families, forced to suffer and tolerate the long distances between them and their loved ones. Aging mothers, women with children and even families under extreme financial strain are forced to travel long distances only to visit their loved ones for a few minutes at a time; a predicament that is not only difficult but also intolerable. Take for example the suffering father of Zia Nabavi who wrote a letter to the head of the judiciary stating "I come from a family of simple peasants, rural workers with little to no financial resources. I have worked hard my entire life to earn a honorable, yet simple living for my family. We don't even have the financial resources to visit our child in a far away location such as Ahvaz."

In a short note, Zahra Rahnavard, writer and university professor expressed grave concern against unjust sentences that send political prisoners to exile. Zia Nabavi, a student deprived from completing his university degree, was for example sent to exile to Karoon prison in Ahvaz.  According to Kaleme, the content of this note is as follows:

The families of political prisoners have demanded nothing more than the unconditional release of their loved ones. Birthdays, mournings, national and religious celebrations such as "Mehregan" and the start of the new academic year are all opportunities for prayer and worshiping God.

All the families of political prisoners have ever looked forward to and asked for is that their loved ones be released from jail unconditionally. Unfortunately however, they have only found themselves facing new challenges imposed by the ruling powers, the latest of which is punishment through exile to far away prisons.  As a result of this newly imposed punishment, proud and resilient prisoners such as Shiva Nazar Ahari, Zia Nabavi, Ahmad Karimi, Hamed Rouhinejad, Majid Dori and others have either been sent to exile to far away prisons or have received sentenced and are painfully awaiting this bitter predicament together with their families. 

Zia Nabavi, a student activist has said on many occasions that he has no affiliation what so ever with any group outside of Iran. He has insisted that his only crime has been to fight for his right to an education; a right that was stripped from him and his friends by the 9th government.  Zia's cell mates have written and spoken extensively of his moral values, and in particular his resilience and mind boggling patience. They say that Zia never holds any grudges, not even against the judge who sentenced him to 15 years exile in a far away prison. This fact it clearly evident in the recent letter Zia wrote to the judge in charge of his case file.  Someone like Zia does not belong in jail; he does not deserve to sent to exile in a far away prison.

Exile to a far away prison not only punishes the prisoners, but also punishes their families, forced to suffer and tolerate the long distances between them and their loved ones. Aging mothers, women with children and even families under extreme financial strain are forced to travel long distances only to visit their loved ones for a few minutes at a time; a predicament that is not only difficult but also intolerable. Take for example Zia Nabavi suffering father who wrote a letter to the head of the judiciary stating "I come from a family of simple peasants, rural workers with little to no financial resources. I have worked hard my entire life to earn a honorable, yet simple living for my family. Today at the age of 55 I can hardly work and after God, I turn to my son for hope. Not only is our son no longer amongst us, but we don't even have the financial resources to visit him in a far away location such as Ahvaz."

The judicial authorities should be ware that God is monitoring and controlling their actions and as a result they should finally put an end to their unjust actions.  Not only should prisoners not be exiled to far away prisons, but the authorities should make sure that they are freed unconditionally. If they do so, I am sure that they will please Mahdi, the hidden Imam. 


عتراض زهرا رهنورد به حبس در تبعید ضیا نبوی و دیگر زندانیان

چکیده : حبس در تبعید نه تنها مجازات زندانی بلکه مجازات خانواده هایی است که ناچارند مشقت طی کردن راه های دور را تحمل کنند ،مادران پیر ،زنان بچه دار ،و حتی خانواده های تهیدست . برای هر یک از آنها طی کردن این مسافتها برای ملاقاتی کوتاه و چند دقیقه ای سخت و غیر قابل تحمل است .به عنوان مثال پدر رنجدیده ضیا نبوی اخیرا در نامه ای به دیوانعالی کشور نوشته است که «خانواده من جزء طبقات پایین اقتصادی جامعه و از صنف دهقانی- کارگری ساده روستایی هستند و من تمام عمر با زحمت وتلاش کار کرده ام تا لقمه حلالی برای فرزندانم کسب کنم. ما حتی توان مالی کافی برای رفتن به ملاقات فرزندم در جای دور افتاده ای چون اهواز را هم نداریم.»


زهرا رهنورد، نویسنده و استاد دانشگاه در یادداشتی کوتاه نسبت به اجرای احکام حبس در تبعید برای زندانیان سیاسی از جمله ضیا نبوی، دانشجوی محروم از تحصیل که به تازگی به زندان کارون اهواز تبعید شده ،اظهار نگرانی کرده است.
به گزارش کلمه ،متن کامل این یادداشت به شرح زیر است:

تمام درخواست خانواده های زندانیان سیاسی آزادی بدون قید و شرط عزیزان شان بوده است. تولدها ،سوگواری ها و جشنهای مذهبی و ملی همچون مهرگان در آغاز سال تحصیلی جدید هر یک فرصتی است برای دعا و نیایش به درگاه الهی که “الهی فک کل اسیر” .
تمام دلخوشی و درخواست خانواده های زندانیان سیاسی آزادی بدون قید و شرط زندانیان بوده است که ناگهان خانواده ها با ابتکار جدیدی از سوی دست اندرکاران مربوطه روبرو شدند. مجازات جدیدی که به صورت زندان در تبعید است .طبق این رویه زندانیانی سر فراز و مقاوم چون شیوا نظر آهاری،ضیا نبوی ،احمد کریمی ،حامد روحی نژاد ، مجید دری و دیگران یا یه زندانهای دیگر تبعید یا به آن محکوم شده اند و هر لحظه انتظار تلخی خود و خانواده هایشان را آزار می دهد.

ضیا نبوی ،فعال دانشجویی بارها گفته است که هیچ وابستگی به گروههای خارج از ایران ندارد و تنها گناهش دفاع از حق تحصیلی است که در دولت نهم از او و دوستانش گرفته شده بود.هم بندان ضیا بسیار در باره سجایای اخلاقی وی بویژه روحیه مقاوم و صبر شگفت انگیزش نوشته و گفته اند .آنها می گویند ضیا آنقدر بی کینه است که حتی کمترین کینه و خشمی نسبت به قاضی ای که او را به پانزده سال حبس در تبعید محکوم کرده ، ندارد و این را به خوبی می توان در نامه ای که به تازگی برای قاضی پرونده اش نوشته ،حس کرد.جای چنین انسانی زندان ،آن هم زندان در تبعید نیست.

خوب است مسوولان قضایی خدا را ناظر و شاهد بگیرند و برای همیشه به این گونه ظلم ها پایان دهند . نه تنها زندانی در تبعید بلکه همه زندانیان را بدون قید و شرط آزاد کنند و مطمئن باشند دل امام زمان را شاد کرده اند

BREAKING NEWS- Seyed Ali Reza Beheshti Shirazi, Mousavi's Senior Advisor Released from Prison Hours Ago

Sunday October 3rd, 2010 - Summary: Seyed Ali Reza Beheshti Shirazi, one of Mousavi's senior advisors who was arrested in December last year, after enduring weeks of solitary confinement and many months in the general ward, was released hours ago on 50,000 USD bail.

Seyed Ali Reza Beheshti Shirazi was released a few hours ago on bail. Beheshti Shirazi, senior advisor to Mousavi who had been arrested since December of last year, had endured weeks of solitary confinement and months of incarceration in the general ward, was released hours ago on 50,0000 USD bail.  Beheshti Shirazi is one of the warriors of the holy war and Secretary of State during Mousavi's time as prime minister. During the 20 years in which Mousavi was censored and remained silent, Beheshti Shirazi continued his cultural activities.

Beheshti Shirazi returned to the political scene when Mousavi entered the presidential elections in 2010 as one of his senior advisers.

چکیده : مشاور ارشد میرحسین موسوی که از دیماه سال گذشته در بازداشت موقت به سر می برد پس از تحمل هفته ها زندان انفرادی و ماهها بازداشت در بند عمومی ساعتی پیش با قرار وثیقه ۵۰۰ میلیون تومانی آزاد شد.

سید علیرضا بهشتی شیرازی ساعتی پیش به قید وثیقه آزاد شد.
به گزارش خبرنگار کلمه مشاور ارشد میرحسین موسوی که از دیماه سال گذشته در بازداشت موقت به سر می برد پس از تحمل هفته ها زندان انفرادی و ماهها بازداشت در بند عمومی ساعتی پیش با قرار وثیقه ۵۰۰ میلیون تومانی آزاد شد.
بهشتی شیرازی از رزمندگان  دوران دفاع مقدس و دبیر هیات دولت در دوره میرحسین موسوی بود. وی در دوره بیست ساله سکوت و سانسور موسوی  به فعالیت های فرهنگی پرداخت. بهشتی شیرازی با بازگشت موسوی به عرصه انتخابات در قامت مشاور وی به عرصه سیاست بازگشت.

Female Political Prisoners & Newborns at Evin Prison Deprived of Drinking Water

Sunday October 3rd, 2010 - According to reports from "Human Rights and Democracy Activists in Iran", ward 2, a female ward at Evin has been deprived of drinking water for the past 24 hours, resulting in poor health conditions for female political prisoners, regular prisoners and newborns held at this ward.  Water has been cut off completely at ward 2 for the past 24 hours, making it difficult for female prisoners to have access to drinking water. The lack of water has also lead to undesired sanitary conditions resulting in a number of female prisoners experiencing diarrhea and nausea. 

Ward 2 also includes a number of newborns and toddlers under the age of two, incarcerated with their mothers. The lack of water has also led to undesired health conditions for these children and their mothers.

So far all complaints to prison officials by female political prisoners and other female prisoners has been in vane. The head of this ward, Mrs. Rezai, has refused to answer their requests and to take care of the problem. If water is not restored to this ward, it will result in further deterioration of the health conditions, putting the lives of these prisoners at risk.

The water used at the women's ward at Evin is drilled through through the main water wells at Evin.  This water is not hygienic and has resulted in acute kidney problems and other health conditions for both the prisoners held in this prison.

Currently there are only 20 female political prisoners being held at Evin prison.  Their names are as follows:

محروم کردن زنان زندانی سیاسی زندان اوین از آب آشامیدنی



بنابه گزارشات رسیده به "فعالین حقوق بشر و دمکراسی در ایران" بند 2 زنان زندان اوین بیش از24 ساعت است که از داشتن آب آشامیدنی محروم هستند و زنان زندانی سیاسی ،عادی و کودکان شیرخوار در شرایط حادی بهداشتی قرار دارند.
آب بند 2 زنان زندان اوین بیش از24 ساعت است که قطع می باشد. در این بند زندانیان سیاسی زن در اسارت بسر می برند.قطعی آب باعث شده است که زنان زندانی به سختی به آب آشامیدنی دسترسی پیدا کنند. قطع شدن آب همچنین باعث ایجاد مشکلات حاد بهداشتی شده است و تعدادی از زندانیان در اثر حاد شدن وضعیت بهداشتی این بند دچار اسهال و حالت تهوع شده اند.

در بند2 زنان زندان اوین تعدادی نوزاد شیرخوار و کودکان زیر 2 سال که همراه با مادرانشان زندانی هستند نگهداری می شوند . قطعی آب باعث حاد شدن وضعیت بهداشتی کودکان و مادران آنها گردیده است.

مراجعه و اعتراضات مکرر زنان زندانیان سیاسی و سایر زندانیان تا به حال بی نتیجه بوده است . رئیس بند پاسداری بنام خانم رضایی از پاسخ دادن و حل مشکل حاد آنها خوداری می کند . در صورت ادامه یافتن قطعی آب می تواند باعث شیوع بیماریهای مختلف دراین بند شود و جان زندانیان را در معرض خطر قرار دهد.

آب مصرفی بند زنان از چاه های که در زندان اوین حفر شده است تامین می شود. این آب غیر بهداشتی است و باعث مشکلات حاد کلیوی و غیره برای زندانیان سیاسی و سایر زندانیان گردیده است.

در حال حاضر فقط در بند زنان زندان اوین 20 زن زندانی سیاسی در بازداشت بسر می برند که اسامی آنها به قرار زیر می باشد:زندانیان سیاسی نازیلا دشتی، عاطفه نبوی ،مهدیه گلرو ، زهراجباری ،فرح واضحان ،کبری زاغه دوست ، عالیه اقدام دوست ، صبا رضوانی ،هنگامه شهیدی ،بهاره هدایت ،پروین جواد زاده ،ریحانه حاج ابراهیم دباغ ،سوسن تریانیان ، منیژه صفر الهی ، فاطمه خرم جو، مطهره بهرامی حقیقی، عذرا سادات قاضی میر سعید، کفایت ملک محمدی، فاطمه رهنما

فعالین حقوق بشر و دمکراسی در ایران،قطع آب نوشیدنی برای مدت طولانی علیه زنان زندانیان سیاسی ، عادی و کودکان شیر خوار بی دفاع را محکوم می کند و از کمیسر عالی حقوق بشر و سایر مراجع بین المللی خواستار اقدامات عملی برای پایان دادن به جنایت علیه بشریت در ایران است.

Majid Dori - Mr. Prosecutor, Please Return My Diary to Me

Saturday October 2nd, 2010 - Summary: The diary that Tehran prosecutor was referring to in his press conference belongs to Majid Dori, a starred [rating system for politically active students] student who was arrested after the controversial elections last year and is still behind bars at Evin.  In a letter addressed to Tehran's prosecutor, Dori makes reference to his diary, explaining the reasons behind why he decided to keep a diary while in prison.  Despite the new restrictions imposed on political prisoners in jail, this letter made it out of Evin with the help of anonymous Green friends and was made available to Kaleme.

In a press conference not long ago, Tehran's prosecutor announced that one of the political prisoners in ward 350 at Evin prison had fit his diary inside a milk carton, seeking to get it out to his family through a cell mate who had been given visitation rights with his own family.  The prison guards however became aware of this plan and confiscated the prisoner's diary.  After this incident, based on orders by Tehran's prosecutor, the restrictions on the political prisoners at Evin's ward 350 were increased three fold.

The complete content of the letter written by Majid Dori to Tehran's Prosecutor Jafari Dolatabadi is as follows:

To the honorable Attorney General,

With greetings,

Two weeks ago at a press conference you made reference to the fact that you intended to provide prisoners with temporary leave of absence from jail and reinstate visitation rights with their families, but one of the prisoners had sought to smuggle his 100 page diary out of prison by hiding it in a milk carton.  Since this diary you made reference to belongs to me, I would like to bring the following points to your attention:

  1. The last time I was allowed to meet with my family in person was six months ago. In the past few months I have only been allowed to meet with them from behind a booth. Interestingly enough, you have restricted physical visitations to only one family member at a time. Is it fair to ban even direct family members to visit their loved ones in prison together?  Is it fair that a father, mother, sister, brother, spouse or child, should only be allowed to visit individually on a monthly basis and from behind a window?  I have been in jail for 15 months, without temporary leave of absence, facing an unjust sentence.  Isn't banning all telephone contact and depriving prisoners from hearing the voices of their friends and loved ones, restricting their physical visitation rights and depriving them of temporary leave of absence not considered putting pressure on political prisoners? 
  2. The only way I knew how to confront these ever increasing pressures and restrictions was to write a diary. They were my personal, daily experiences and since I wanted to avoid violation of my privacy and the fact that anyone for what ever reason would have the right to look into my thoughts, thoughts written about days that felt like months, I decided to transfer my diary out of prison.  Since anything written in prison with the intent to be taken out is searched and given that I had not had a physical visitation with my family in six months, it was impossible for me to get my diary to my family.  I therefore hid my diary order to ensure that my thoughts would remain private and that it would not be opened and read.
  3. I taped the diary shut, writing a note on the cover addressed to the person who was to have transferred it out of prison stating that my diary was entrusted to them and that until the day that it would be delivered to me in person, no one had the right to open it. It was therefore personal to the extent that I did not want anyone other than myself to read the content. This also clearly demonstrates that I never had the intention to publish any of its content. There was nothing in my dairy but personal memories and experiences of my days in prison and as a result the content was only my business and no one elses.
Since you have indicated that writing a personal journal is not a crime, I therefore ask that you order that this diary which includes my personal memories be returned to me.  I ask that you please respect and honor the privacy of individuals.

چکیده : صاحب آن دفترچه خاطرات که دادستان در مصاحبه مطبوعاتی اش از آن سخن گفت مجید دری ،دانشجوی ستاره داری است که پس از انتخابات پرمناقشه سال گذشته بازداشت شد و تاکنون در زندان اوین است.دری در نامه ای خطاب به دادستان تهران در باره دفترچه خاطراتش و دلیل نگارش خاطراتش در زندان برای وی توضیح داده است .نامه مجید دری با وجود همه محدودیت های تازه که بر زندانیان اعمال می شود ،با کمک یاران گمنام جنبش سبز در اوین به بیرون راه یافته و در اختیار کلمه قرار گرفته است.

کلمه :دادستان تهران چندی پیش در یک مصاحبه مطبوعاتی اعلام کرد که یک زندانی سیاسی در بند ۳۵۰ اوین، با جاسازی دفترچه خاطراتش در یک قوطی شیر ،تلاش کرده که از طریق یکی از هم بندانش که ملاقات حضوری داشته ،آن را به دست خانواده اش برساند اما زندانبانان متوجه این ماجرا شده و دفترچه خاطرات زندانی را گرفته اند. پس از این اتفاق به دستور دادستان تهران محدودیت ها برای زندانیان سیاسی بند ۳۵۰ چند برابر شده است.

دادستان محترم عمومی و انقلاب تهران

با سلام

دو هفته ی پیش طی یک کنفرانس خبری عنوان داشتید که به زندانیان مرخصی و ملاقات داده می شود اما یکی از زندانیان دفتر خاطرات ۱۰۰ صفحه ای خود را در پاکت شیر جاسازی کرده بود و قصد انتقال به بیرون زندان را داشت.با توجه به اینکه مورد یاد شده مربوط به من می شد موارد ذیل را به اطلاع می رسانم:

۱٫شخص بنده آخرین ملاقات حضوری که با خانواده ام داشتم ، شش ماه پیش بود و در این چند ماه فقط ملاقات کابینی داشتم و جالب اینکه ملاقات حضوری را منحصر به یکی از اعضای خانواده کرده اید.آیا این درست است که حتی اعضای درجه یک نتوانند به ملاقات حضوری زندانی خود بیایند؟آیا این درست است که پدر،مادر،خواهر،برادر،و یا همسر و فرزند-در صورت ترتیب ماهی یکبار ملاقات حضوری-هرکدام جداگانه بدون حجاب شیشه ملاقاتی داشته باشند؟اکنون ۱۵ ماه است که بدون مرخصی در زندانم و با حکمی نا عادلانه روبرو. آیا قطع کردن تلفن و عدم امکان شنیدن
صدای دوستان و اقوام،محدودیت در ملاقات حضوری و عدم استفاده از مرخصی فشار بر زندانیان سیاسی تلقی نمی شود؟

۲٫حال با توجه به این محدودیت ها که هرروزبیشتر و شدیدتر میشود،تنها راه مقابله با این فشارها را نوشتن خاطرات دانستم،خاطرات شخصی و روزانه و برای جلوگیری از تعرض به این حریم-که هر کس به هر دلیل وعنوان حق ورود به آن و تفتیش را برای خود مجاز می شمرد- وحفظ ونگهداری روزهایی که هرروزش ماههاست،تصمیم به انتقال آن به بیرون را گرفتم.از آنجاییکه هر نوشته ای بخواهد از زندان بیرون رود مورد تفتیش واقع میشود و نظر به این امر که ۶ماه است ملاقات حضوری نداشته و امکان اینکه به دست خانواده ام برسانم نیز فراهم نبود پس جهت اطمینان بیشتر و اینکه کسی آنرا باز نخواهد کرد،پنهان کردن و شخصی ماندنش اهمیتی بیشتر برایم داشت.

۳٫ جهت اطمینان بیشتر دفتر را بر چسب زده ، بر صفحه ی اول آن خطاب به کسی که دفترچه را در بیرون زندان دریافت می کرد، نوشته بودم که این دفتر به صورت امانت نزد شما بماند و تا تحویل به خودم حق باز کردن آن را ندارید.پس آنقدر شخصی بوده است که نخواهم کسی غیر از خودم آن را بخواند و به طریق اولی روشن می شود که قصد انتشار هم به هیچ عنوان نداشته ام.چیزی نبود جز خاطرات کاملاً شخصی وثبت روزهایی که در زندان بودم پس تنها به من مربوط می شد نه دیگری.

لذا با توجه به مطالب بالا و با عنایت به اینکه جنابعالی گفته بودید که نوشتن خاطرات جرم نیست خواهشمندم دستور فرمایید این دفتر که بخشی از زندگی روزانه ی من و خاطرات و نوشته هایم می باشد به من بازگردانده شود.لطفا حریم شخصی افراد را محترم بشمارید.
