Ardeshir Amir Arjomand, Mousavi's Advisor Speaks Out Against Human Rights Violations In Iran

In an interview with the Green television outlet RASA, Ardeshir Amir Arjomand, Mousavi's adviser (now in Paris) discusses the extensive human rights violations in Iran. Amir Arjomand points to the recent alarming news regarding the physical condition of political prisoners behind bars in Rajai Shahr prison and Evin's female ward (fema...le political prisoners are still being held in the Methadone ward) and the rise in the number of political prisoners deprived of their basic human rights.

Amir Arjomand also points to the recent alarming news regarding the deteriorating physical condition of Mostafa Tajzadeh an incarcerated senior member of the Mojahedin of the Islamic Revolution Organization [reformist organization not to be confused with the MKO], explicitly holding Iran's Judiciary and all institutions and individuals associated with the judiciary directly responsible for the well being of all those behind bars.

Amir Arjomand reiterated the Green movement's support for the rights of every individual in Iran, regardless of their ethnic background, political affiliation, gender and ideology and said "Our support for human rights is based on human dignity and justice and we unequivocally denounce all human rights violations, particularly as it relates to political prisoners. We warn the country's officials and in particular those responsible for the Judiciary that based on the laws of our nation and the universal human rights guaranteed under the law, the main responsibility for the psychological and physical well being of those behind bars remains with them."

Amir Arjomand continued: "Those individuals who remain captive to the judiciary, the security forces and semi military forces and claim that the responsibility lies with the authorities within the judiciary and the security forces, rendering them powerless are by no means relieved of their responsibilities towards our nation. Their lack of action will leave a negative mark on their service to the nation and their judicial and political history, for not only will they be viewed as individuals incapable of handling their own responsibilities but also as projecting their negative motivations, thoughts and ideas on others. Someone must ask the important question of who is responsible here? If those in charge of the judiciary are not responsible then whom? In all countries where there is a rule of law, those responsible for the judiciary and security of the nation must work within the jurisdiction of the judicial and security related institutions. These same individuals now claim that they are not responsible and that it is others who must preserve our security and honor. Those who have washed their hands of all responsibility must know that each and every one of them will be held accountable and their names will be registered along side others known for violating human rights in Iran. The nation of Iran will never forget that you did not have the courage to accept responsibility. If you are afraid of taking responsibility, if you are incapable of accepting responsibility, at least have the courage to resign from your post. If you claim that you are being pressured and as a result you cannot perform your duties, then have the courage to resign, for remaining responsible and continuing these atrocities will only lead to your misery and demise."

Revolutionary Court Renders Verdict On Nasrin Sotoudeh's "Hejab" Case

April 19th, 2011 - According to the website Change For Equality, after three sessions, the 28th Branch of the Revolutionary Court finally rendered a verdict on the hejab charges [non conformance with Islamic dress code] against Nasrin Sotoudeh. Sotoudeh has been ordered to pay 50,000- Touman [$50 USD]. As per a statement issued by the court, the verdict may be contested.

Soutoudeh was charged with non conformance with the Islamic dress code [hejab] after giving an acceptance speech for an Italian Human Rights award, in a taped video message in which her hair was not covered. Sotoudeh gave her acceptance speech in a video message as she was banned for leaving the country and could therefore not attend the ceremony in person.

Prior to this ruling, there had been a number of false reports attributing 5 years of Soutoudeh's 11 year prison sentence to the hejab case against her.

Nasrin Sotoudeh's Heart Warming Letter to Her 11 Year Old Daughter Mehraveh

Friday April 4th, 2011 - While the U.S. PEN Association announced that they will be awarding Nasrin Sotoudeh their American PEN Award for 2011 for her work in defending human rights and freedom of expression, Sotoudeh herself was busy writing a letter to her 11 year old daughter Mehraveh from Evin prison.  The content of Sotoudeh's letter to her daughter is as follows:

To my dearest Mehraveh, my daughter, my pride and joy,

I greet you from Evin's ward 209 and hope that you are doing well.  I come to you without concerns, sadness and tears and instead greet you with a heart filled with love and best wishes for you and your beloved brother.

It has been six months since I was taken away from you my beloved children. Throughout these six months we were only allowed to see each other a few times and even then in the presence of security agents.  During this time I was never allowed to write to you, to receive a picture, or even meet with you freely without any security restrictions. My dear Mehraveh, you more than anyone understand the sorrow in my heart and the conditions under which we were allowed to meet. Each time, after each visit and every single day, I struggle with the notion of whether or not I have taken into consideration and respected my own children's rights. More than anything I needed to be sure that you my beloved daughter whose wisdom I very much believe in, did not accuse me of violating my own children's rights.

My dearest Mehraveh, I began reflecting upon your rights and that of your brother from the very first day I was arrested. Because of your age, I worried more about you.  I worried about your ability to endure, your judgment of the situation, your morale and most importantly I worried about the effect it [my arrest and incarceration] would have on your interactions with your peers at school.  It wasn't long however, before all my doubts and concerns were put to rest and I knew that I, better said we, were able to stand firm and true to our convictions.

Your strength and endurance was no less than mine. I once told you: "My daughter I hope you never think that I was not thinking of you or that it was my actions that deserved such punishment". I later continued with confidence: "Everything I have done is legal and within the framework of the law." It was then that you lovingly caressed my face with your small hands and replied: "I know mommy.... I know...." It was on that day, because of the confident manner in which you spoke, that I was freed of the nightmare of being judged by my own daughter.

My dearest daughter, my concerns regarding your interactions with your peers at school were also completely unfounded, for the young generation is always more intellectually mature and wiser than the generation preceding it.

... and so I was able to rid myself of all concerns and stand strong and firm. I owe this strength to you and your father.

My dearest Mehraveh, allow me to share with you some of our fonder memories. When night falls, while I lay in prison, I often think about how I used to put you to sleep. Of all the lullabies and songs I sang for you in bed, you were most fond of the one called "Fairies". Every night as you fell asleep, you'd ask me to recite it to you and I would gladly begin with...

Once upon a time,
Three fairies sat bare naked as dusk approached....

My dearest daughter, you were my main motivation for pursuing children's rights. I thought then and still believe that all my efforts in the area of children's rights will benefit no one more than my own children. Every time I came home from court, after having defended an abused child, I would hold you and your brother in my arms, finding it hard to let go of your embrace. To this day, I don't understand why... perhaps by holding you closely in my arms I wanted to compensate for the pain of the victims of child abuse.

I recall you telling me once that you don't wish to be 18 years old.  When I inquired as to why you responded that you'd hate to be denied the benefits of childhood and that of being a child. You cannot imagine how happy your response made me.  I can't recall how many times you reminded your father and I that you are still a child, that you are not 18 yet and that we should respect your childhood and your rights as a child....

You demanded that we respect your rights as a child and I am so glad you did, for at times neglect can lead us to disregard another persons rights, even if the other individual happens to be our own child. Through the eyes and the words of a child you reminded us adults who saw ourselves as your protector of the importance of having respect for the rights of others, demanding ones rights, justice, a legal framework, equality and other such important matters.

My dearest Mehraveh, just like I was never able to disregard your rights and always sought to protect them to my fullest capacity, I was also never able to disregard the rights of my clients.

How could I abandon the scene as soon as I was summoned [by the ruling government], knowing that my clients were behind bars?  How could I abandon them when they had hired me as their legal council and were awaiting their trial? Never... I could never do such a thing....

In closing I want to tell you once again that it was my desire to protect the rights of many, particularly the rights of my children and your future that led me to represent such cases in court. I believe that the pain that our family and the families of my clients have had to endure over the past few years is not in vain. Justice arrives exactly at a time when most have given up hope. It arrives when we least expect it. I am certain of it.  My only wish for you is a childhood full of happiness and joy.  If you are upset with the interrogators and judges as a result of the case against me, bestow peace and tranquility upon them with your childlike melody so that as a result we too can achieve much deserved tranquility and peace of mind.

I miss you my dearest and send you one hundred kisses,

Maman Nasrin [your mother Nasrin]

MUST READ - Hossein Karroubi Talks About His Father's Continued Detention & The Future of the Green Movement

Wednesday April 13th, 2011 -  In an email interview with Roozonline, Hossein Karroubi, Mehdi Karroubi's son states that he has become a fugitive and although he describes the current situation as difficult and dark, reiterates that his father always believed that this approach to governance is unsustainable and the regime will sooner or later have to give in to the will of the people, for there is no opponent more formidable than the people of Iran, a nation that now more than ever, has serious doubts about the legitimacy of its own government.

It has been more than a few weeks without any news regarding Mr. and Mrs. Karroubi. Have you been provided with an update on their condition? Except for the visitations that took place under tight security, have they [the ruling government] indicated how long this situation will last? Have they defined any conditions under which the current situation might change?

The truth is that we have not been informed of any so called conditions.  My mother and father are apparently under the control of the Intelligence Ministry and defining conditions is outside the jurisdiction of the Intelligence Ministry. Of course we must not forget that the head of the Judiciary himself has claimed that dealing with the reformists and the so called "heads of the sedition" is outside the realm of his responsibility. In other words, no one, not even the head of the Judiciary is willing to accept responsibility for any incident occurring after the house arrest and if restrictions are imposed or continued, it is higher ranking officials that must therefore provide guidance, make decisions and define conditions.  The question that remains unanswered is whether discussing any so called "conditions" is of relevance when the individuals in question are under "detention" and an illegal and inhumane act has been committed. In my opinion the issue of so called conditions becomes mute when the reality is so dark and dire. As we Iranians say, "Is there any color darker than black?"

Some are of the opinion that in order to defeat the Green movement, the authorities of the Islamic Republic have resorted to eliminating all communication between Mr. Mousavi, Mr. Karroubi and the people of Iran and given the current situation they will no longer allow these gentlemen to have direct contact with the people. What is your opinion regarding this hypothesis? Will the Green movement fail as a result of these latest developments?

On the contrary, in my opinion, rendering Mr. Karroubi and Mr. Mousavi incommunicado presents both an opportunity and a threat; an opportunity for the nation of Iran and a threat to the existing regime.  Both Mr. Karroubi and Mr. Mousavi have repeatedly stated that the people of Iran have found their path. They are vibrant and dynamic, insisting upon their demands and becoming more determined with the passing of each day.  In contrast, the regime has only been able to control the country through pressure and oppression. Those in power are so incapable and helpless that they were not only fearful of what might happened at the funeral services for Mir Hossein Mousavi's late father, but they also feared allowing events such as a funeral services for a member of the parliament and a burial ceremony for a mother of one of the supporters of the Green movement.  I recall my father telling us about the glorious ceremony that was held during the time of the Shah's regime when Ayatollah Saeedi was martyred in prison.  At the time the Shah's regime did not take any action to prevent the ceremony from taking place. This demonstrates that unlike the Shah who at the time was confident of the stability of his regime, these gentlemen are not. The Green movement benefited from certain boundaries and a specific framework and set of demands as a result of the presence of Mr. Karroubi and Mr. Mousavi. However the current actions taken by the regime have led to a variety of demands and conditions within the Green movement. These demands will change and become even more varying with the passing of time.

How do you think the Green movement should proceed, given your understanding of Mr. Karroubi's viewpoints?

The people's demands are clear and the more the regime resorts to violence, the higher the demands of the people will be in response to that violence.  Knowing how to govern and dealing with such issues is an art form. In practice, I witnessed the significant change between the spirit and positions of Mr. Karroubi and Mr. Mousavi in June pf 1999 [after the presidential elections] as apposed to January and February of 2011. In other words, they remaining the companions of our people, a nation that consists of a variety of factions and individuals with differing intellectual viewpoints and at the same time sought to further the cause of the Green movement in a logical and reasonable manner. Those who now play the role of spokesperson for these two honorable men, must neither fall short, nor resort to extremes, for any weakness in communicating the situation at hand will only lead to the frustration of our people. At the same time, these friends [referring to those who are representing Mousavi and Karroubi in their absence] should take advantage of all of our country's sympathetic and well intentioned forces for this movement does not belong to any particular group or political party. It belongs to all segments of our society. Ignoring these principles will have a negative impact on the movement, while the correct understanding and handling of them will have positive impact.

How did Mr. Karroubi feel about the future of the Green movement? Was he optimistic about the future and the goals of the movement?

One day prior to his house arrest, in a video message that made it out to the Green media outlets, Mr. Karroubi spoke explicitly of the promise of victory. Even prior to recording his last video message, my father always believed that this approach to governance was unsustainable. He believed that the regime will sooner or later have to give in to the will of the people, for there is no opponent more formidable than the people of Iran, a nation that now more than ever, has serious doubts about the legitimacy of its own government.  It is not surprising that these gentlemen are engaging in concocting new stories every day in order to regain their lost legitimacy.  One day they attribute the government subsidies to Mahdi [the last Imam] and the next day they engage in vulgar behavior such as producing a CD entitled "Judgment Day is Near".  In reality these gentlemen only seek to compensate for their lack of acceptance, with the goal to rebuild their tarnished image.  In my opinion however, this type of behavior and playing with the values and religious beliefs of our people, will only result in a large setback for the ruling government.

Did Mr. Karroubi predict the current conditions prior to his house arrest? If so what was his opinion regarding the leadership of the Green movement and how it should proceed moving forward?

First and foremost these four honorable individuals are not under house arrest, as house arrest has a specific definition. These beloved individuals have been incarcerated. As for your question, Mr. Karroubi and Mr. Mousavi awaited the arrival of such a day long ago and were always ready for any type of confrontation.  From the very beginning, Mr. Karroubi believed that we have a very difficult road ahead of us. He believed that the leadership of the movement should be in the hands of individuals who are steadfast and willing to pay any price.  He believed that the leadership should be in the hands of individuals who in addition to being assertive, would make decisions that were logical and reasonable and in the best interest of the people. For if God forbid the movement would fall in the hands of individuals who were weak or opportunistic, as the Green movement could end up with the same fate as that of the Reform Movement.

In conclusion, please tell us about the condition of Mr. Karroubi's children. How are you all doing?

Unfortunately when they were unable to get a hold of me and I was able to escape, they went after my brother Ali. He was accused of ridiculous crimes such as spying for other Persian Gulf countries and after a few weeks in prison was finally released on bail.  Except for the fact that my two brothers have been banned from leaving the country, the ruling government has not created any other problems for them.  As for me, I have become a fugitive. I have to wait and see what the future holds and what God has in store for me.

Nasrin Sotoudeh's 3 Year Old Son in Anguish: "Mommy Is Never Coming Back..."

Translator's Note: How do you turn your back on an innocent 3 year old boy longing for his mother? Tell me how? How do you ignore the plight of an innocent child who has been deprived of the comfort of his mother's arms? What was her crime you ask? Why was she taken away from her family and sentenced to 11 years behind bars? Nasrin Sotoudeh dared to stand up for Human Rights. She dared to represent the voiceless in a court of law. She had the courage to stand up for hundreds of prisoners of conscience behind bars in the Islamic Republic of Iran. How can we turn our back on Nasrin Sotoudeh, her husband Reza Khandan and her two innocent, young children? It is now upon us to act as the voice for the voiceless, for if we turn our back on Soutoudeh and her 3 year old son and young daughter, we will have turned our back on humanity...

Tuesday April 12th, 2011 - In an interview with The Center to Defend Families of those Slain and Detained in Iran, Reza Khandan Nasrin Sotoudeh's husband points to the psychological pressure exerted on his family by Iran's judiciary. Khandan also describes how they have been deprived of basic rights afforded all prisoners such as visitation with his incarcerated wife and the painful circumstances of their two young children who have been brutally denied of their mother's presence at such a tender age.

The content of the interview with Khandan is as follows:

Mr. Khandan, if at all possible, can you please describe Nasrin Sotoudeh's condition and the pressure exerted upon her and your family?

I visited the prosecutor's office prior to the Persian New Year [Norooz] requesting a face to face meeting with my wife.  They asked that I provide them with a written request and I complied.  In response to my written request and in the presence of 30 - 40 individuals, they stated that they would grant us a face to face visitation which they later reneged. On Thursday March 24th, we planned to visit with Nasrin as Thursdays are visitation days, but we were told that the prison was closed [for the Norooz holidays]. The next week, on Thursday March 31st, we once again headed for Evin with the hope to visit with my wife. Many others from across the country and other provinces were also waiting to meet with their incarcerated loved ones on that day, but the prison gates were once again closed. Unfortunately when the prison gates are closed, no one is available to answer any questions. We waited for 4 or 5 hours, losing almost an entire work day and still no one showed up. To date we have had only three, ten minute phone conversations with Nasrin. I no longer attempt to contact the prosecutor's office as it is fruitless. The last time I approached the prosecutor's office, I was arrested for approximately 10 minutes under the pretext that I had raised my voice. The prosecutor does not feel obligated to answer any questions. As a result, I have stopped contacting his office and making any demands.

How are your children holding up? Do they miss their mother?

We some how manage, but it's very difficult on the kids, particularly during Norooz when people visit each others homes. While they themselves [the regime officials] were busy with the hustle and bustle of Norooz and visiting their loved ones to their heart's content, they deprived us of all visitation. We were neither allowed a minute of face to face visitation nor even a visitation from behind a cabin.

My son is unable to cope. He has lost all hope. Last night during a short telephone conversation with his mother he broke down and told her that she was never going to come back.  The reality is slowly sinking in and things are deteriorating with the passing of each day.  His mind is filled with strange notions. He is convinced that his mother is never coming back. He argues with me and insists that she is not coming back.  My daughter has her own problems. Her aunt is even more worried about her, because she has a tendency to internalize everything. She is also at a challenging age. I'm at a loss. I don't know what to do....

I think we may just go outside the prison as a family, set up a tent and remain there in protest. No one answers us. No one pays any attention to the myriad of letters we have written [to the prosecutor and the judicial authorities]. It is because of my letters that I was summoned and a case was filed against me.  In the past eight months our children have not even met with their mother for an hour.  Based on Iran's laws, it is intolerable that a child (a three year old toddler) be deprived of seeing his/her mother.  Even though we visited others during Norooz, I wish we hadn't, as the children really missed their mother.  Her absence was very apparent. What could I do? In the end I was forced to take them away from Tehran....
