Tavakoli, imprisoned student activist was previously held in Evin's ward 350 and was transferred to Rajai Shahr prison after going on a 16 day hunger strike in protest to unacceptable prison conditions and insulting behavior by prison officials. He and 18 other political prisoners went on a hunger strike in order to protest the complete disregard for their rights in prison.
It is worth mentioning that based on amendments issued by Branch 1 of the Enforcement of Sentencing for the Prosecutor's Office at Evin, Tavakoli's 8 1/2 year prison sentence was reduced by one year to 7 1/2 years imprisonment. The amendment that Majid Tavakoli received last night reads: "The 8 1/2 year prison sentence shall be amended and reduced to 7 1/2 years."
This 1 year reduction was based on Articles 46, 500 and 610 of the Islamic Penal Code. According to Article 46 of the Islamic Penal Code "In the case of punishable crimes, when an individual has committed more than one crime, the punishment handed will be that which is severest." As a result, based on Article 500 of the Islamic Penal code, the 1 year sentence related to propaganda against the regime was eliminated due to the higher sentence of 5 years based on Article 610 of the Islamic Penal Code.
After the news was leaked by DaneshjooNews that Tavakoli's 8 1/2 year sentence was upheld by the appeals court, Branch 1 of the Enforcement of Sentencing for the Prosecutor's Office at Evin, fully aware that the case had not been attended to in the appeals court and that the sentencing had been upheld by bodies outside of the judiciary, stated that they had the intention to amend the sentence. As a result, an amendment was sent to Rajai Shahr prison and presented to Majid Tavakoli with the goal to swiftly uphold the sentence by the appeals court and squelch any potential activities within the universities with the start of the academic year.
Majid Tavakoli informed his family that his lawyer has requested a reduction in his sentence from the 15th Branch of the Appeals Court. This branch has promised to confer with other bodies and provide a response to this request within two weeks. It is worth mentioning that Tavakoli has announced that given the improper judicial process regarding his case, he is not asking for a reduction in his sentence but rather questioning whether the punishment imposed in connection to his case is legal to begin with.

ملاقات مجید توکلی با خانواده پس از ۲ ماه

مجید توکلی دانشجوی زندانی دانشگاه امیرکبیر پس از ۲ ماه، با خانواده خود دیدار کرد.
به گزارش دانشجونیوز مجید توکلی عضو انجمن اسلامی پلی تکنیک، روز پنج شنبه هفته گذشته پس از دو ماه عدم اجازه ملاقات، توانست با خانواده خود در زندان رجایی شهر کرج ملاقات کند. در این ملاقات مجید توکلی وضع روحی بسیار خوبی داشته است و از همه کسانی که "عید فطر" را به خانواده وی تبریک گفته اند، تشکر کرد.
این دانشجوی زندانی که پیش از این در بند ۳۵۰ اوین زندانی بود، پس از ۱۶ روز اعتصاب غذا در اعتراض به محدودیت ها و برخوردهای توهین آمیز مسئولین زندان، به زندان رجایی شهر کرج تبعید شد. وی به همراه ١٨ تن دیگر از زندانیان در اعتراض به عدم رعایت حقوقشان دست به اعتصاب غذا زده بودند.
همچنین با با اصلاحیه صادر شده توسط شعبه ١ اجرای احکام دادسرای اوین، ٨ سال و نیم محکومیت مجید توکلی با ١ سال کاهش به ٧ سال و نیم تبدیل شد.
در اصلاحیه ای که شب گذشته به دست مجید توکلی رسیده، آمده است: "حکم قطعی ۸ سال و نیم حبس تعزیری به ۷ سال و نیم حبس تعزیری اصلاح می شود."
این کاهش ۱ ساله با استناد به ماده ۴۶ قانون مجازات اسلامی، و حذف محکومیت ماده ۵۰۰ قانون مجازات اسلامی و اجرای ماده ۶۱۰ قانون مجازات اسلامی بوده است. بنابر ماده ۴۶ قانون مجازات اسلامی، " در جرائم قابل تعزير هرگاه فعل واحد دارای عناوين متعدده جرم باشد مجازات جرمی داده می شود كه مجازات آن اشد است." بنابراین محکومیت ۱ ساله ماده ۵۰۰ قانون مجازات اسلامی مبنی بر فعالیت تبلیغی علیه نظام به دلیل اعمال ماده ۶۱۰ و محکومیت ۵ ساله ناشی از آن حذف گشته است.
بعد از درج خبر ۸ سال و نیم محکومیت مجید توکلی در سایت دانشجونیوز، شعبه ۱ اجرای احکام دادسرای اوین با توجه به عدم بررسی پرونده در دادگاه تجدیدنظر و تایید حکم از سوی مراجعی خارج از قوه قضائیه قصد اصلاح حکم را داشته است. با توجه به این موضوع با ارسال اصلاحیه ای به زندان رجایی شهر و ارائه آن به مجید توکلی در شب گذشته قصد داشته تا بر روی روند سریع تایید حکم در دادگاه تجدید نظر در آستانه مهرماه و شروع فعالیت دانشگاه ها، سرپوش گذاشته شود.
مجید توکلی در تماس با خانواده خود اعلام داشته که وکیل وی از شعبه ۱۵ دادگاه تجدید نظر خواهان تخفیف مجازات شده است که این شعبه با اعلام استعلام از مراجع دیگر قول پاسخ تا ۲ هفته اینده را داده است. این در حالی است که مجید توکلی اعلام کرده است که با توجه به روند نادرست قضایی طی شده خواهان اعمال تخفیف مجازات در رابطه با حکم غیرقانونی خود نیست.
